Cover overview: Property Dispute cover

We are launching a new insurance product that will provide cover for 'live' property risks (risks that are not insurable in the Legal Indemnities market).

This might be of use for clients involved in litigation on the defendant side or where you have identified a risk but conversations between the parties have already taken place thus excluding the risk from the Legal Indemnities market.

 The policy provides cover for:

  • Defendant’s own legal costs
  • Disbursements
  • Adverse costs
  • Awards should the case settle unsuccessfully

The cover kicks in over an agreed retention (excess) and the goal is to give the client certainty of the cost of litigation and allow them to continue with their work. This is a tested product in the Right of Light market and is known as an agreed conduct policy.

As an example this could be where a developer has been in discussions with a third party that is holding them to ransom because of a restrictive covenant. Because conversations have already taken place with the claimant, Legal Indemnity insurers will not cover this risk. Our product would allow the developer to continue with their work as we will agree a litigation strategy with the developer’s solicitors and cover any losses over the retention that has been agreed.
