If you are a director or officer of a Management company, you are accountable for all acts that are negligent, outside your authority or in breach of duty or trust. Since there is no limit on liability, a legal action against you can be financially catastrophic. Even if you are completely exonerated, defence costs alone can be astronomical.
Fortunately, cover is available at very reasonable premiums to protect you against these risks, in the form of a Directors and Officers insurance policy. We would strongly recommend to all officers of Management companies that this cover is in place before you accept the position.
A Contractors All Risks or Contract Works policy provides cover for building works. This will typically include accidental damage, theft and malicious damage cover for the following during the period of the contract:
- Work in progress, materials on site or in temporary storage
- Loss or damage to plant and equipment and temporary buildings
- Contractual responsibility for hired in plant and equipment including continuing hire charges
This cover is absolutely essential for building contracts; without it, if the works are damaged before being handed over who else is going to pay for debris to be removed and the works performed again?

As a property owner it is your duty to ensure that electrical systems within your control are safely maintained. If the property is multi-tenanted, this relates to the common areas. We strongly recommend that any fixed electrical systems are examined every 3-5 years and we are able to organise this for you.
Property owners have a duty to identify, assess and manage any asbestos containing materials on their premises. Clear can help you to do this with cost effective surveys.
Property owners and/or their agents are required to take preventative and protective measures against any risk to the health and safety of employees and tenants as well as members of the public. Clear can arrange assessments so that you can identify these risks.
Property owners are now legally required to ensure that their buildings are energy efficient. For commercial businesses, this means you need an Energy Performance Certificate (EPC) for the construction, sale or lease of buildings. Clear can help you to obtain this.
